The Director, Community Planning Scarborough District recommends that:

1. City Council enact a Part Lot Control Exemption By-law for Lots 8 and 9 within Plan 66M-2605, municipally known as 6175, 6183 Kingston Road, and 1, 2, 4, 7, 10 and 11 Franklin Avenue substantially in accordance with the Draft Part Lot Control Exemption By-law included as Attachment 4, and as generally illustrated on the Draft Part Lot Control Exemption Plan on Attachment 3, to be prepared to the satisfaction of the City Solicitor and to expire two (2) years following enactment by City Council.

\r\n

 

\r\n

2. Prior to the introduction of the Part Lot Control Exemption By-law, City Council require the owner to:

\r\n

 

\r\n

a. provide proof of payment of all current property taxes for the subject lands to the satisfaction of the City Solicitor; and

\r\n

 

\r\n

b. submit a revised draft R-plan be submitted to comply with the City’s integration requirement. The plan should be integrated into 3-degree MTM, Zone 10, NAD 83 CRSRS, and at least two coordinate values need to be shown on the main corners of the subject parcel, and a schedule/table on the plan.

\r\n

3. City Council authorize and direct the City Solicitor to register the Part Lot Control Exemption By-law on title.

4. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Part Lot Control Exemption By-law as may be required.

c. submit a certification from the project Consulting Engineer confirming that all site servicing locations have been completed in accordance with the approved Site Plan application drawings and to the satisfaction of the Director, Engineering Review. Any deviation from the approved drawings shall require an amendment to the Site Plan Control approval prior to the lifting of Part Lot Control.

\r\n

 

\r\n

3. City Council authorize the City Solicitor to take the necessary steps to release the Section 118 Restriction from all or any portion of the lands in the City Solicitor's sole discretion after consulting with the Executive Director, Development Review Division, at such time as confirmation is received that a plan of condominium has been registered or upon expiry or repeal of the Part Lot Control Exemption By-law.

4. City Council authorize and direct the City Solicitor to register the Part Lot Control Exemption By-law on title.

5. City Council authorize the City Solicitor to repeal or amend the Part Lot Control Exemption By-law to delete part of the lands described in the bylaw, if the City Solicitor determines, in her sole discretion after consulting with the Executive Director, Development Review Division, that it is necessary prior to releasing or partially releasing the 118 Restriction from title.

6. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Part Lot Control Exemption By-law as may be required.

Transportation Services is requesting approval for the installation of a designated on-street accessible loading zone on the east side of Ellington Drive, between Lawrence Avenue East and Guild Hall Drive.  The accessible loading zone will operate from 7:00 a.m. to 9:00 a.m. and from 3:00 p.m. to 5:00 p.m., Monday to Friday.  The establishment of this accessible loading zone (ALZ) will provide unimpeded curbside access for the Wheel-Trans users in the subject area.

The proposed amendment will change the timing of existing parking prohibition, currently in effect from 2:00 a.m. to 6:00 a.m., to be in effect at all times. The proposed amendments will enhance safety and facilitate easier vehicle movements for residents exiting their driveways on this section of the street.

The location was flagged by residents as having an accident in previous years, in addition to this crossing being a main pedestrian pathway for students leaving St. Teresa Shrine Catholic Public School. The location is immediately adjacent to a major six-lane section of Kingston Road that functions similarly to a highway, with high vehicle speeds, complex turning movements, and challenging sightlines. Parents and school staff report that driver behaviour, including aggressive driving and failure to yield, further increases the risk for children and families walking to and from school.

\r\n

Given these ongoing concerns, and in light of the unique design and operating conditions at this intersection, I am requesting that Scarborough Community Council override the technical analysis and authorize the placement of a temporary school crossing guard at Kingston Road Near St. Theresa Shrine Catholic School until December 31, 2026. This temporary measure would provide an important layer of protection for students and families while longer term safety and design improvements are explored.

The school parent community has continued to raise serious concerns about safety at this intersection. The location is immediately adjacent to a major six-lane section of Kingston Road, with high vehicle speeds, complex turning movements, and challenging sightlines. Parents and school staff report that driver behaviour, including aggressive driving and failure to yield, further increases the risk for children and families walking to and from school.

\r\n

Given these ongoing concerns, and in light of the unique design and operating conditions at this intersection, I am requesting that Scarborough Community Council override the technical analysis and authorize the placement of a temporary second school crossing guard at Kingston Road and McCowan Road/Cathedral Bluffs Drive until December 31, 2026. This temporary measure would provide an important layer of protection for students and families while longer term safety and design improvements are explored.

This proposed motion is intended to address safety concerns for all road users, particularly children, seniors, pedestrians, and cyclists using Birchcliff Avenue and Freeman Street. This intersection is a key travel route for students and families walking to and from Birch Cliff Public School, and residents have raised concerns about driver behaviour and the potential for serious collisions. All-way compulsory stop controls are a proven traffic calming tool that help reduce vehicle speeds, clarify right-of-way, and create safer crossing opportunities for pedestrians at residential intersections. Although not technically warranted at this location, implementing an all-way stop at Birchcliff Avenue and Freeman Street will improve safety, support active school travel, and enhance the quality of life for residents. This proposed motion is intended to address safety concerns for all road users, particularly children, families, and seniors who live, walk, and travel along East Haven Drive. East Haven Drive is a key access route for students attending Cliffside Public School, and residents have reported concerns about vehicle speeds and cut-through traffic on this corridor. The surrounding neighborhood is home to many school-aged children and vulnerable road users who rely on safe, comfortable conditions for walking, cycling, and accessing transit. Reducing the speed limit from 40 km/h to 30 km/h is consistent with the City’s Vision Zero road safety objectives and will help calm traffic, reduce the risk and severity of collisions, and create a safer environment for students and community members travelling to and from Cliffside Public School.

While Transportation staff doesn’t not typically recommend speed limit reductions without traffic calming measures in place. I am advancing this motion as a balanced approach to addressing safety concerns and the needs of the broader community. Going forward our office will continue to work with Transportation Services to consider additional measures, as warranted.
