1. City Council amend the Official Plan for the lands municipally known as 3807-3815 and 3819-3829 Lake Shore Boulevard West substantially in accordance with the draft Official Plan Amendment 817 included as Attachment 6 to this Report.

2. City Council amend City of Toronto Zoning By-law 569-2013 for the lands municipally known as 3807-3815 and 3819-3829 Lake Shore Boulevard West substantially in accordance with the draft Zoning By-law Amendment included as Attachment 7 to this Report.

\r\n

3. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Official Plan Amendment and draft Zoning By-law Amendment as may be required.

\r\n

 

\r\n

4. City Council request that the owner make reasonable commercial efforts to convey off-site parkland to the City equal to the value of the on-site parkland dedication, in fulfilment of the parkland dedication requirements pursuant to Section 42 of the Planning Act, with the off-site parkland dedication to be acceptable to the General Manager, Parks and Recreation and free and clear of any above or below grade encumbrances, with the exception of any encumbrances as may be otherwise approved by the General Manager, Parks and Recreation, to be conveyed prior to the issuance of the first above grade building permit and;

\r\n

 

\r\n

a. In the event that the off-site parkland dedication is less than the value of the on-site parkland dedication, then the owner will pay cash-in-lieu of parkland to make up for the shortfall in parkland dedication, prior to the issuance of the first above grade building permit;

\r\n

 

\r\n

b. In the event that the owner is unable to provide an acceptable off-site parkland dedication to the City, the owner will be required to satisfy the parkland dedication requirement through the payment of cash-in-lieu; and

c. The value of the cash-in-lieu of parkland dedication will be appraised through Real Estate Services and payment will be required prior to the issuance of the first above grade building permit.

City Council direct the City Solicitor and appropriate City staff to attend the Ontario Land Tribunal in support of the proposed development and request to amend the City's Official Plan and applicable zoning by-law as described in the Approval Report of the Executive Director, Development Review (May 16, 2025) for the lands at 3807-3815 and 3819-3829 Lake Shore Boulevard West.

\r\n

2. In the event that the Ontario Land Tribunal allows the appeal, in whole or in part, City Council authorize the City Solicitor to request that the issuance of any final Order be withheld until such time as the City Solicitor advises that:

a. City Council has approved the Rental Housing Demolition Application 23 109926 WET 03 RH under Chapter 667 of the Toronto Municipal Code, pursuant to Section 111 of the City of Toronto Act, 2006, to permit the demolition of the existing rental dwelling units and the owner has entered into, and registered on title to the lands, one or more agreements with the City, to the satisfaction of the Chief Planner and Executive Director, City Planning and the City Solicitor, securing all rental housing related matters necessary to implement City Council's decision.

\r\n

3. City Council authorize the City Solicitor and relevant City staff to take any necessary steps to implement City Council's decision, including requesting any additional conditions of approval that would be in the City's interest, in the event the appeal of Official Plan and Zoning By-law Amendment application is allowed by the Ontario Land Tribunal, in whole or in part.

On June 4, 2025, Etobicoke York Community Council deferred Item EY23.8 (“3807-3815 and 3819-3829 Lake Shore Boulevard West – Official Plan and Zoning By-law Amendment Application – Decision Report – Approval”, dated May 16, 2025). The public meeting for EY23.8 was adjourned to the September 17, 2025 meeting of the Etobicoke York Community Council.

On June 13, 2025, the applicant appealed the application to the Ontario Land Tribunal (OLT) citing City Council’s failure to make a decision on the application within the time frame in the Planning Act. As a result of the appeal, the Ontario Land Tribunal now has approval authority for the application. A Case Management Conference has been scheduled for September 16, 2025.

\r\n

This supplementary report deletes and replaces the recommendations of the Approval Report with new recommendations to reflect the appealed status of the application. Consistent with the Approval Report, staff continue to recommend support for the proposal in its current form.

The Director, Strategic Initiatives, Policy and Analysis recommends that:

\r\n

1. City Council approve the Rental Housing Demolition application File Number 23 109926 WET 03 RH in accordance with Chapter 667 of the Toronto Municipal Code and pursuant to Section 111 of the City of Toronto Act, 2006 to permit the demolition of 14 existing rental dwelling units located at 3807-3815 and 3819-3829 Lake Shore Boulevard West, subject to the following conditions:

\r\n

 

\r\n

a. The owner shall provide and maintain 14 replacement rental dwelling units on the subject site for a period of at least 20 years beginning from the date that each replacement rental dwelling unit is first occupied and, during which time, no application may be submitted to the City for condominium registration, or for any other conversion to a non-rental housing purpose, or for demolition without providing for replacement;

\r\n

 

\r\n

b. The replacement rental dwelling units required by recommendation 1.a. above shall collectively have a total gross floor area of at least 1,042 square metres and be comprised of 7 one-bedroom units, 4 two-bedroom units, and 3 three-bedroom units, as generally illustrated in the plans submitted to City Planning dated April 2, 2025. Any revision to these plans shall be to the satisfaction of the Chief Planner and Executive Director, City Planning;

\r\n

 

\r\n

c. The owner shall, as part of the 14 replacement rental dwelling units required in Recommendation 1.a above, provide at least 4 one-bedroom units, 4 two-bedroom units, and 3 three-bedroom units at affordable rents, and 3 one-bedroom units at mid-range (affordable) rents, as currently defined in the City's Official Plan, all for a period of at least ten years beginning from the date of first occupancy of each unit;

\r\n

 

\r\n

d. The owner shall provide a Tenant Assistance Plan for tenants of the 14 existing rental dwelling units and two dwelling rooms proposed to be demolished at subject site address to the satisfaction of the Chief Planner and Executive Director, City Planning;

\r\n

 

\r\n

e. The owner shall provide tenants of all 14 replacement rental dwelling units with access to, and use of, all indoor and outdoor amenities in the proposed 39-storey building at no extra charge. Access to, and use of, these amenities shall be on the same terms and conditions as any other resident of the building without the need to pre-book or pay a fee, unless specifically required as a customary practice for private bookings;

\r\n

 

\r\n

f. The owner shall provide ensuite laundry and central air conditioning in each replacement rental dwelling unit at no extra charge;

\r\n

 

\r\n

g. The owner shall provide and make available for rent at least nine vehicle parking spaces to tenants of the replacement rental dwelling units. Such parking spaces shall be made available firstly to returning tenants who previously rented a vehicle parking space, and at similar monthly parking charges that such tenants previously paid. The remaining vehicle parking spaces shall be made available to tenants of the replacement rental units to the satisfaction of the Chief Planner and Executive Director, City Planning;

\r\n

 

\r\n

h. The owner shall provide tenants of all replacement rental dwelling units with access to bicycle and visitor parking on the same terms and conditions as any other resident of the proposed development;

\r\n

 

\r\n

i. The replacement rental dwelling units required in Recommendation 1.a. above shall be made ready and available for occupancy no later than the date by which 70% of the new dwelling units in the proposed development, exclusive of the replacement rental dwelling units, are made available and ready for occupancy, subject to any revisions to the satisfaction of the Chief Planner and Executive Director, City Planning; and

\r\n

 

\r\n

j. The owner shall enter into, and register on title to the lands at subject site, an agreement pursuant to Section 111 of the City of Toronto Act, 2006 to secure the conditions outlined in Recommendations 1.a. through 1.i. above all to the satisfaction of the City Solicitor and the Chief Planner and Executive Director, City Planning.

\r\n

 

\r\n

2. City Council authorize the Chief Planner and Executive Director, City Planning, to issue Preliminary Approval of the Rental Housing Demolition Permit under Chapter 667 of the Toronto Municipal Code pursuant to Section 111 of the City of Toronto Act, 2006 for the demolition of the 14 existing rental dwelling units located at 3807-3815 and 3819-3829 Lake Shore Boulevard West after all the following have occurred:

\r\n

 

\r\n

a. All conditions in Recommendation 1 above have been fully secured;

\r\n

 

\r\n

b. The Official Plan and Zoning By-law Amendments for application 22 236554 WET 03 OZ have come into full force and effect;

\r\n

 

\r\n

c. The issuance of the Notice of Approval Conditions for site plan approval by the Executive Director, Development Review or their designate, pursuant to Section 114 of the City of Toronto Act, 2006, or as otherwise determined by the Chief Planner and Executive Director, City Planning;

\r\n

 

\r\n

d. The issuance of excavation and shoring permits (conditional or full permit) for the approved development on the site; and

\r\n

 

\r\n

e. The owner has confirmed, in writing, that all existing rental dwelling units proposed to be demolished are vacant.

\r\n

 

\r\n

3. City Council authorize the Chief Building Official and Executive Director, Toronto Building to issue a Rental Housing Demolition Permit under Chapter 667 of the Toronto Municipal Code after the Chief Planner and Executive Director, City Planning, or their designate, has given Preliminary Approval referred to in Recommendation 2 above.

\r\n

 

\r\n

4. City Council authorize the Chief Building Official and Executive Director, Toronto Building to issue a Residential Demolition Permit under Section 33 of the Planning Act and Chapter 363 of the Toronto Municipal Code for 3807-3815 and 3819-3829 Lake Shore Boulevard West after the Chief Planner and Executive Director, City Planning has given Preliminary Approval referred to in Recommendation 2 above, which may be included in the Rental Housing Demolition Permit under Chapter 667 pursuant to section 6.2 of Chapter 363, on condition that:

\r\n

 

\r\n

a. The owner removes all debris and rubble from the site immediately after demolition;

\r\n

 

\r\n

b. The owner erects solid construction hoarding to the satisfaction of the Chief Building Official and Executive Director, Toronto Building;

\r\n

 

\r\n

c. The owner erects the proposed building on the site no later than three years from the date that the demolition of the existing rental dwelling units commences, subject to the timeframe being extended at the discretion of the Chief Planner and Executive Director, City Planning; and

\r\n

 

\r\n

d. Should the owner fail to complete the proposed building within the time specified in Recommendation 4.c. above, the City Clerk shall be entitled to enter on the collector’s roll, as with municipal property taxes, an amount equal to the sum of twenty thousand dollars ($20,000.00) per dwelling unit for which a demolition permit is issued, and that such amount shall, until payment, be a lien or charge upon the land for which the Residential Demolition Permit is issued.

\r\n

 

\r\n

Etobicoke Lakeshore (Ward 3) has approximately $2.6 million in Section 37 Community Benefit funding from nearby development applications that may be available to support advancing this project through the capital budget process. Staff will work with the local councillor on the potential allocation of this funding once more detailed cost have been determined.

The City of Toronto leases approximately 485 hectares (1200 acres) of Hydro One corridors from Infrastructure Ontario for recreation purposes across the city. Under the Master Licence Agreement, as managed by the Parks and Recreation division, these lands support a network of multi-use trails and a variety of recreational uses as well as meadow re-naturalization projects.

Parks and Recreation were directed by City Council in December 2024 to explore opportunities to improve a 7.3 ha Hydro One corridor in Ward 3 between Islington Avenue and Royal York Road, which is currently informally used by the neighbourhood, and add these lands to the Master License Agreement.

\r\n

Staff have met with Hydro One to discuss formalizing access for local recreation in this corridor if all hydro infrastructure safety setbacks and maintenance access can be assured. This is a progress report on the initial investigation, potential funding sources and design and approval processes.

1. Etobicoke York Community Council direct the General Manager of Transportation Services to negotiate an encroachment agreement with the property owner of the premises municipally known as 170 Emmett Avenue, which contains the facility referred to as West Park Healthcare Centre, which would allow for the use of a portion of the public right of way on the west side of Emmett Avenue and Eglinton Avenue West, for one illuminated electronic static ground sign,, the encroachment agreement to contain all of the following conditions, and such other terms and conditions which the General Manager, Transportation Services or the City Solicitor may deem necessary in the interest of the City:

\r\n

 

\r\n

a. The property owner of 170 Emmett Avenue indemnifies the City from and against all actions, suits, claims or demands and from all loss, costs, damages, and expenses that may result from such permission granted; and from the use of the public right of way for the erection or display of a sign;

\r\n

 

\r\n

b. The property owner of 170 Emmett Avenue must ensure that all electrical wiring and connections for the illuminated sign comply with the Ontario Electrical Safety Code, including maintaining the minimum clearance between the sign’s nearest boundary and any overhead electrical conductors as specified by the Ontario Building Code;

\r\n

 

\r\n

c. The property owner of 170 Emmett Avenue must submit a compliance report, signed by a qualified professional, verifying adherence to item (b) to Permits and Enforcement following the installation of the sign;

\r\n

 

\r\n

d. The property owner of 170 Emmett Avenue must maintain the sign at their own expense in a good state of repair and in a condition deemed satisfactory by the General Manager of Transportation Services and must not make any additions or modifications to the encroachment beyond what is permitted under the terms of the encroachment agreement;

\r\n

 

\r\n

e. The property owner of 170 Emmett Avenue accepts such additional conditions as the City Solicitor or the General Manager of Transportation Services may deem necessary in the interest of the City;

\r\n

 

\r\n

f. The property owner of 170 Emmett Avenue must remove the sign upon receiving written notice from the General Manager, Transportation Services to do so;

\r\n

 

\r\n

g. The property owner of 170 Emmett Avenue agrees to provide and maintain sufficient clear sight lines to the vehicular traffic, pedestrians, cyclists walking or riding from vehicles on Emmett Avenue making southbound right onto Eglinton Avenue West as deemed necessary by the General Manager, Transportation Services, in their sole and absolute discretion;

\r\n

 

\r\n

h. The property owner of 170 Emmett Avenue shall ensure that the encroachment agreement with the City of Toronto is registered on-title of all relevant properties, at the sole expense of the property owner of 170 Emmett Avenue;

\r\n

 

\r\n

i. The property owner of 170 Emmett Avenue obtains signoff from the Toronto Public Utilities Coordinating Committee, Urban Forestry, Metrolinx, the Toronto Regional Conservation Authority  and Transportation Services’ Street Furniture unit;

\r\n

 

\r\n

j. The property owner of 170 Emmett Avenue shall submit stamped sign drawings, prepared by a Professional Engineer licenced in the Province of Ontario, to Transportation Services;

\r\n

 

\r\n

k. The property owner of 170 Emmett Avenue shall agree that the City and/or utility companies may remove the encroachment at any time in order to install or maintain services within the affected public right of way with no obligation to replace them;

\r\n

 

\r\n

l. The property owner of 170 Emmett Avenue shall apply to the appropriate City Official for the required sign permits applicable to the sign under Municipal Code Chapter 694, Signs, General or Chapter 693, Signs, Election or Temporary, Article 6, Vehicular Destination Signs, Neighbourhood and Business Area Identification Signs and Construction Hoarding Signs, as may be applicable;

\r\n

 

\r\n

m. The property owner of 170 Emmett Avenue shall ensure that no sign is erected until permits for the sign are obtained from the appropriate City Officials; and,

\r\n

 

\r\n

n. The property owner of 170 Emmett Avenue shall ensure that the sign is only erected, displayed and maintained in accordance with the requirements of sign permits issued; and provisions of Chapter 694, or Chapter 693, Article 6, as may be applicable;

\r\n

 

\r\n

o. The encroachment agreement is fully executed prior to any permits being issued for the sign; and,

\r\n

 

\r\n

p. The property owner of 170 Emmett Avenue pays all applicable fees related to the permitting of the sign and the preparation of the encroachment agreement, and in relation to the provision of the permission granted for the private use of the public right of way.

As the City Councillor for Ward 5, York South-Weston I am writing to express my strong support for new housing and to recommend the waiver of application fees associated with the Holding By-law Amendment applications for the following properties: 87 Ethel Avenue and 2595 St. Clair Avenue West.

\r\n

City staff have been working diligently to expedite the approvals process and help facilitate the creation of more housing in Ward 5. Both 87 Ethel Avenue and 2595 St. Clair Avenue West Zoning By-law Amendments were approved by City Council to permit greater heights and densities in keeping with Provincial and municipal planning policies and growth targets. Together, they propose to bring nearly 2000 residential units to the community, including 141 affordable units.

\r\n

 

\r\n

Holding provisions were necessary to bring the implementing zoning by-laws to City Council for consideration in a timely manner. The holding provision for 87 Ethel Avenue is to secure affordable housing through an affordable housing agreement. The holding provision for 2595 St. Clair Avenue West is to confirm rail safety and air/noise quality concerns are appropriately addressed through peer review. Both applicants and City staff have been working diligently towards satisfying the requirements of these provisions.

\r\n

Holding By-law Amendment applications to remove the holding provisions and bring the zoning by-laws into effect are anticipated shortly. This process is delegated to Executive Director, Development Review and their designate. The waiving of application fees for both sites would remove an additional cost for these applicants, who would then be able to move through the Site Plan Control process and construct this much needed housing.

1. That the Etobicoke York Community Council direct the Director, Development Review, Etobicoke York District, in consultation with CreateTO, to report to the October 21 2025 Community Council meeting with a summary of:

a. The CreateTO sale of City property to the applicant, and the process used to plan the entire site using the public and private public lands

\r\n

 

\r\n

b. The Council-approved development concept for the site and the performance metrics contained within the Council decision on 2021.EY25.1

\r\n

 

\r\n

c. The multitude of Committee of Adjustment applications, Council decisions and other applications and decisions, and their cumulative effect on the Council-approved development concept and performance metrics

\r\n

 

\r\n

d. Pending decisions by various authorities including the Ontario Land Tribunal, Council or the Committee of Adjustment

\r\n

 

\r\n

e. The status of retail or non-residential uses planned for the site, including the grocery store

\r\n

 

\r\n

f. Actions taken by the applicant to date to create the 587 new housing units approved in 2021

\r\n

 

\r\n

g. Federal, Provincial or Municipal commitments on affordable housing or other incentives for the site

\r\n

 

\r\n

2. The Etobicoke York Community Council request the Director, Development Review, Etobicoke York District, to make a presentation to the October 21 2025 Community Council meeting on the matters contained in recommendation 1.

The development site at Richview Square Plaza located at 250 Wincott Drive and 4620 Eglinton Avenue West has a long and complicated history, and also remains active through various applications to Council and to the Ontario Lands Tribunal. There are a number of connected Committee of Adjustment decisions, with the latest as recent as September 11, 2025, which allowed for a new residential floor above the approved metric height limit of one of the buildings.

\r\n

 

\r\n

The original open air retail plaza has existed for many years serving as the heart of the community by providing local goods and services to residents. In 2018 an application was made to request high density residential development on the mixed-use site. The planning process continued through to 2021 with several iterations, extensive community involvement, and a special real estate deal through CreateTO to sell the City-owned lands along the Eglington Avenue frontage to provide a single cohesive assembly.

\r\n

 

\r\n

In July 2021 Council approved a plan with three new mid-rise buildings A/B/C at equivalent heights of 11/11/12 storeys containing a grand total of 587 units, new non-residential space, a new park and POPS and affordable housing units. A significant portion of the retail plaza, building D, was retained.

\r\n

 

\r\n

Since the 2021 Council decision, there have been numerous changes, requests to the Committee of Adjustment and appeals to the Ontario Land Tribunal. With each change, Council’s vision for this site under the 2021 real estate deal and the planning decision has been incrementally replaced with the developer’s own aspirations.

\r\n

 

\r\n

In January 2023, the applicant requested to rezone buildings A and B from 11 storeys each to taller ones, now 24 and 29 storeys, representing a very significant departure from the mid-rise solution originally supported by both by Council and the surrounding community. This application is currently under review by City staff.

\r\n

 

\r\n

At the centre of this development project is a City real estate deal where public land was sold to have a better planning outcome, a complete community, and to meet City building objectives, within the context of the comprehensive mid-rise plan. That plan is quickly disappearing, and a number of questions and concerns persist among community members who are exasperated with the barrage of changes and a departure from a shared vision that included a public land deal.

\r\n

 

\r\n

The community and other participants in the various decision making processes deserve a comprehensive accounting to where this development project is today, and what the pending decisions are from the various authorities. This piecemeal planning approach is eroding public trust and is an unsustainable way to shape the future of our City. It also raises questions about the best use of public land resources and a reconciliation of results. In light of all of these activities and changes, I am requesting the support of the Community Council to urgently bring clarity on the current status of this site and to allow for better preparations for upcoming decisions.
