The Director, Community Planning, Scarborough District recommends that:

\r\n

 

\r\n

1. City Council approve the Rental Housing Demolition application (20 209873 ESC 20 RH) in accordance with Chapter 667 of the Toronto Municipal Code and pursuant to Section 111 of the City of Toronto Act, 2006 to permit the demolition of eight (8) rental dwelling units at 3291 Kingston Road, subject to the following conditions:

\r\n

 

\r\n

a. The owner shall provide and maintain eight (8) replacement rental dwelling units on the subject site for a period of at least 20 years beginning from the date that each replacement rental unit is first occupied and, during which time, no applications may be submitted to the City for condominium registration, or for any other conversion to a non-rental housing purpose, or for demolition without providing for replacement. The eight (8) replacement rental dwelling units shall collectively have a total gross floor area of at least 659 square metres and be comprised of one (1) one-bedroom, three (3) two-bedroom, and four (4) three-bedroom units, as generally illustrated in the plans submitted to the City Planning Division dated November 15, 2023. Any revision to these plans shall be to the satisfaction of the Interim Chief Planner and Executive director, City Planning Division;

\r\n

 

\r\n

b. The owner shall, as part of the eight (8) replacement rental dwelling units required in Recommendation 1.a. above provide at least one (1) one-bedroom, three (3) two-bedroom, and four (4) three-bedroom units at affordable rents defined as gross monthly rent no greater than one times the average City of Toronto rent by unit type, as reported annually by the Canada Mortgage and Housing Corporation all for a period of at least ten (10) years beginning from the date of first occupancy of each unit. Rents shall not include additional charges for ensuite laundry or central air conditioning;

\r\n

 

\r\n

c. The owner shall provide an acceptable Tenant Relocation and Assistance Plan to all Eligible Tenants of the existing rental dwelling units proposed to be demolished at 3291 Kingston Road, addressing the right to return to occupy one of the replacement rental dwelling units at similar rents, and other assistance to lessen hardship. The Tenant Relocation and Assistance Plan shall be developed in consultation with, and to the satisfaction of, the Interim Chief Planner and Executive Director, City Planning Division;

\r\n

 

\r\n

d. The owner shall provide tenants of all eight (8) replacement rental dwelling units with access to, and use of, all indoor and outdoor amenities in the proposed development at no extra charge. Access to, and use of, these amenities shall be on the same terms and conditions as any other resident of the development, without the need to pre-book or pay a fee unless specifically required as a customary practice for private bookings;

\r\n

 

\r\n

e. The owner shall provide ensuite laundry in each replacement rental dwelling unit within the proposed development;

\r\n

 

\r\n

f. The owner shall provide at least one (1) one-bedroom replacement rental dwelling unit and four (4) three-bedroom replacement rental dwelling unit with balconies and three (3) two-bedroom rental replacement units with Juliet balconies for private and exclusive access by the tenants of such units;

\r\n

 

\r\n

g. The owner shall provide central air conditioning in each replacement rental dwelling unit within the proposed development;

\r\n

 

\r\n

h. The owner shall provide and make available at least eight (8) vehicle parking spaces to tenants of the replacement rental dwelling units. Such parking spaces shall be made available firstly to returning tenants who previously rented a vehicle parking space, and at similar monthly parking charges that such tenants previously paid. The remaining vehicle parking spaces shall be made available to tenants of the replacement rental units to the satisfaction of the Interim Chief Planner and Executive Director, City Planning Division;

\r\n

 

\r\n

i. The owner shall provide tenants of the replacement rental dwelling units with access to bicycle and visitor vehicular parking on the same terms and conditions as any other resident of the proposed development;

\r\n

 

\r\n

j. The eight (8) replacement rental dwelling units required in Recommendation 1.a above shall be made ready and available for occupancy no later than the date by which seventy percent (70%) of the new dwelling units in the proposed development, exclusive of the replacement rental dwelling units, are made available and ready for occupancy; and

\r\n


k. The owner shall enter into and register on title to the lands at 3291 Kinston Road, 2 and 4 Windy Ridge Drive an agreement pursuant to Section 111 of the City of Toronto Act, 2006 to secure the conditions outlined in Recommendations 1.a through 1.k above, all to the satisfaction of the City Solicitor and the Interim Chief Planner and Executive Director, City Planning Division.

\r\n

 

\r\n

2. City Council authorize the Interim Chief Planner and Executive Director, City Planning to issue Preliminary Approval of the Rental Housing Demolition Permit under Chapter 667 of the Toronto Municipal Code pursuant to Section 111 of the City of Toronto Act, 2006 for the demolition of the eight (8) rental dwelling units at 3291 Kingston Road after all the following have occurred:
 

\r\n

a. all conditions in Recommendation 1 above have been fully satisfied and secured;

\r\n

 
b. The Official Plan Amendment has come into full force and effect;

\r\n

 

\r\n

c. the Zoning By-law Amendment has come into full force and effect;

\r\n

 

\r\n

d. the issuance of the Notice of Approval Conditions for site plan approval by the Interim Chief Planner and Executive Director, City Planning or their designate pursuant to Section 114 of the City of Toronto Act, 2006;

\r\n

 
e. the issuance of excavation and shoring permits (conditional or full permits) for the approved development on the site; and

\r\n

 
f. the owner has confirmed, in writing, that all existing rental dwelling units proposed to be demolished are vacant.

\r\n

 

\r\n

3. City Council authorize the Chief Building Official and Executive Director, Toronto Building Division to issue a Rental Housing Demolition Permit under Chapter 667 of the Toronto Municipal Code after the Interim Chief Planner and Executive Director, City Planning Division has given Preliminary Approval referred to in Recommendation 2 above.
 

\r\n

4. City Council authorize the Chief Building Official and Executive Director, Toronto Building Division to issue a Residential Demolition Permit under Section 33 of the Planning Act and Chapter 363 of the Toronto Municipal Code for 3291 Kingston Road and  2 and 4 Windy Ridge Drive after the Interim Chief Planner and Executive Director, City Planning Division has given Preliminary Approval referred to in Recommendation 2 above, which may be included in the Rental Housing Demolition Permit under Chapter 667 pursuant to section 6.2 of Chapter 363, on condition that:
 

\r\n

a. the owner removes all debris and rubble from the site immediately after demolition;

\r\n

 
b. the owner erects solid construction hoarding to the satisfaction of the Chief Building Official and Executive Director, Toronto Building Division;

\r\n

 
c. the owner erects the proposed building no later than four (4) years from the date on which the demolition of the existing rental dwelling units commences, subject to the timeframe being extended to the discretion of the Interim Chief Planner and Executive Director, City Planning Division; and

\r\n

 
d. should the owner fail to complete the proposed development containing eight (8) replacement rental dwelling units within the time specified in Recommendation 4.c. above, the City Clerk shall be entitled to enter on the collector’s roll, as with municipal property taxes, an amount equal to the sum of twenty thousand dollars ($20,000.00) per dwelling unit for which a demolition permit is issued, and that such amount shall, until payment, be a lien or charge upon the land for which the Residential Demolition Permit is issued.

5. City Council authorize the appropriate City officials to take such actions as are necessary to implement City Council's decision, including execution of the Section 111 agreement and other related agreements.

This report recommends approval of the Rental Housing Demolition application to demolish a two-and-a-half storey rental apartment building comprised of eight rental dwelling units at 3291 Kingston Road. The units will be replaced with eight new rental dwelling units as part of the approved redevelopment of the site consisting of a 12-storey residential building with 357 dwelling units in addition to the replacement units.

Two of the eight rental units at 3291 Kingston Road were previously demolished without permits and are recommended to be included in the Rental Housing Demolition permit and replaced as part of the application. The proposal also includes the provision of a Tenant Relocation and Assistance Plan for all eligible tenants of the existing rental dwelling units, including the right to return to a replacement rental dwelling unit. The proposal also includes the demolition of two owner-occupied, single-detached houses at 2 and 4 Windy Ridge Drive.

\r\n

The properties are also the subject of an Official Plan Amendment and Zoning By-law Amendment application (20 209863 ESC 20 OZ) which was appealed by the owner to the Ontario Land Tribunal (OLT) in August 2022 due to a lack of decision from  City Council. The Ontario Land Tribunal issued a written decision on November 10, 2023, approving the proposed Official Plan amendment and Zoning By-law Amendment in principle, with the final order being withheld until all outstanding matters, including the necessary agreements with the City, are secured, including considerations related to rental housing matters.

\r\n

 

\r\n

This report recommends approval of the Residential Demolition Permit under Chapter 363 of the Toronto Municipal Code, subject to conditions.

City Council accepted a settlement offer for a portion of the subject site which will result in lands at 1891 Eglinton Avenue East being redeveloped with a mixed use proposal consisting of a total of four buildings: three towers, with heights of 48 storeys (Building A), 44 storeys (Building B), 44 storeys (Building C), and one mid-rise building with a height of 12 storeys (Building D). The buildings would comprise a total gross floor area (GFA) of approximately 106,831 square metres of which102,190 square metres is residential gross floor area and 4,641 square metres is non-residential gross floor area. A total of approximately 1,700 residential units are proposed.

\r\n

 

\r\n

A Detailed Noise and Vibration Impact Study was prepared by RWDI to support to the proposed development at 1891 Eglinton Avenue East which concludes that the proposed development site is suitable for a Class 4 designation as defined in the NPC-300 Environmental Noise Guideline. The study was peer-reviewed for the City by RJ Burnside and Associates Limited and they concluded that the Class 4 area designation for the proposed development site is supportable.

\r\n

 

\r\n

Under NPC-300, a Class 4 Area designation allows for higher daytime and night-time sound level limits than would otherwise be permitted in relation to a noise sensitive land use such as residential dwellings and associated outdoor living areas. Any impact of the permitted higher levels would be mitigated by noise control measures that are part of the development of sensitive uses. Similarly, the slight increase in permitted noise levels provide for the continued operation of surrounding employment uses without impact caused by the introduction of residential uses on the subject lands. The Class 4 designation would apply to the identified portion of 1891 Eglinton Avenue East shown in Attachment 3 to this report and any future development of the site would be subject to further peer-review and potentially further reporting to City Council.

2. City Council authorize the City Solicitor and appropriate City staff to continue discussions with the applicant to address outstanding issues, including but not limited to those outlined in this report.

\r\n

 

\r\n

3. In the event that the Ontario Land Tribunal allows the appeals in part, City Council instruct the City Solicitor to request the Ontario Land Tribunal to withhold its Order on the until such time as the Ontario Land Tribunal has been advised by the City Solicitor that:
 

\r\n

a. the form and content of the Official Plan and Zoning By-law Amendments and conditions of Draft Plan of Subdivision approval are satisfactory to the Interim Chief Planner and Executive Director, City Planning and the City Solicitor;

\r\n

 

\r\n

b. the Owner has at its sole cost and expense:

\r\n

 

\r\n

1. submitted a revised Functional Servicing Report, Stormwater Management Report, and Hydrogeological Review, including the Foundation Drainage Report or addendums (\"Engineering Reports\"), to the satisfaction of the Chief Engineer and Executive Director, Engineering and Construction Services, in consultation with the General Manager, Toronto Water;

\r\n

 

\r\n

2. secured the design and provision of financial securities for any upgrades or required improvements to the existing municipal infrastructure identified in the accepted Engineering Reports, to support the development, all to the satisfaction of the Chief Engineer and Executive Director, Engineering and Construction Services and the General Manager, Toronto Water, should it be determined that improvements or upgrades are required to support the development, according to the accepted Engineering Reports, accepted by the Chief Engineer and Executive Director, Engineering and Construction Services and the General Manager, Toronto Water;

\r\n

 

\r\n

3. ensured the implementation of the accepted Engineering Reports does not require changes to the proposed amending By-laws or any such required changes have been made to the proposed amending By-laws, to the satisfaction of the Interim Chief Planner and Executive Director, City Planning and the City Solicitor, including the use of a Holding (\"H\") By-law symbol regarding any new or upgrades to existing municipal servicing infrastructure as may be required;

\r\n

 

\r\n

4. submitted a revised Transportation Impact Study or addendum, acceptable to, and to the satisfaction of, the General Manager, Transportation Services and the Chief Engineer and Executive Director, Engineering and Construction Services and that such matters arising from such study, be secured if required;

\r\n

 

\r\n

5. submitted a revised Arborist Report or addendum and Tree Protection Plan acceptable and satisfactory to the General Manager, Parks, Forestry and Recreation;

\r\n

 

\r\n

6. the Owner has made revisions to meet the Toronto Green Standard requirements to the satisfaction of the Interim Chief Planner and Executive Director, City Planning;

\r\n

 

\r\n

7. the Owner has submitted a revised Housing Issues Report to the satisfaction of the Interim Chief Planner and Executive Director, City Planning;

\r\n

 

\r\n

8. the Owner has submitted a revised Draft Plan of Subdivision to the satisfaction of the Interim Chief Planner and the Executive Director, City Planning;

\r\n

 

\r\n

9. the Owner has submitted a revised Rail Safety and Risk Mitigation study and it has been peer reviewed to the satisfaction of the Interim Chief Planner and Executive Director, City Planning;

\r\n

 

\r\n

10. the Owner has submitted a revised Air Quality and Land Use Compatibility Assessment   and it has been peer reviewed to the satisfaction of the Interim Chief Planner and Executive Director, City Planning; and

\r\n

 

\r\n

11. the Owner has submitted a revised Noise and Vibration Feasibility Study and it has been peer reviewed to the satisfaction of the Interim Chief Planner and Executive Director, City Planning.

\r\n

 

\r\n

c. the City's conditions of subdivision approval, including all parkland dedication and improvement related matters, and requirements stemming from the review and acceptance of appropriate functional servicing and stormwater management reports referenced in Recommendation 3. b above have been finalized and submitted prior to the Tribunal's Final Order.

\r\n

 

\r\n

4. City Council authorize the City Solicitor and City Staff to take and necessary steps to implement City Council's decision.

On July 6, 2021, Official Plan Amendment, Zoning By-law Amendment and Draft Plan of Subdivision applications were submitted to permit the redevelopment of 180 and 260 Brimley Road. The application also seeks to remove  the Holding \"H\" symbol in the existing zoning to facilitate the development of the  proposed plan of subdivision for an area of 15.625 hectares

The subdivision proposed a number of new public streets, a new public park and blocks to support the construction of 1,337 dwelling units comprised of 215 back-to back townhouses, 950 stacked back-to-back townhouses and 172 on-street townhouses.

\r\n

 

\r\n

On February 14, 2024, the Applicant appealed the applications to the Ontario Land Tribunal (the \"OLT\") due to City Council failing to make a decision within the prescribed time frames in the Planning Act.

\r\n

 

\r\n

This report recommends that the City Solicitor together with appropriate City staff attend the Ontario Land Tribunal hearing to oppose the application in its current form and to continue discussions with the Applicant to resolve outstanding issues.

In response to a series of development applications and interest for sites near the Eglinton GO station, City Council directed City Planning staff to initiate a Planning Study for the segment of Eglinton Avenue East generally between McCowan Road and Mason Road. The subsequent Council adoption of Official Plan Amendment 570 identified lands around Eglinton GO Station as a Protected Major Transit Station Area and included Site and Area Specific Policy 625 that provides for minimum densities for sites within the PMTSAs. With the planning framework anticipating intensification and limited guidance for the lands from a policy or zoning perspective it was important to examine the area and determine appropriate built form guidance for future development. The Urban Design Guidelines recommended for adoption in this report respond to the original Council direction and reflect a work plan initiated, developed and implemented by City Planning staff and informed by community and landowner consultation.

\r\n

The Eglinton GO Area Urban Design Guidelines will assist in advancing the vision of a connected and sustainable community along a vibrant commercial main street anchored by the Eglinton GO Station and the Eglinton East Light Rail Transit (EELRT) line. The Guidelines seek a diversity of building types that will frame and support an attractive, green, and memorable public realm supporting non-residential uses at grade.

This report recommends that City Council adopt the Eglinton GO Area Urban Design Guidelines. Transportation Services is recommending parking amendments on Lee Centre Drive to improve accessibility and sightlines for pedestrians crossing to/from Lee Centre Park. Installing pedestrian crossing protection would be potentially unsafe and problematic on this street, due to the road alignment and the presence of driveways. However, parking changes can be implemented to improve sightlines and remove parked vehicles from the uncontrolled pedestrian crossing desire lines.

These changes will result in the loss of approximately three pay-and-display parking spaces on the south side of the north leg of Lee Centre Drive. However, to add parking in the area and offset the loss of these spaces noted above, Transportation Services has confirmed it is feasible to install approximately three new pay-and-display parking spaces on the east side of the west leg of Lee Centre Drive.

This meeting of the Scarborough Community Council will be conducted with members participating in person and remotely.

To provide comments or make a presentation to the Scarborough Community Council: The public may submit written comments or register to speak to the Committee on any item on the agenda. The public may speak to the Community Council in person or by video conference.

Closed Meeting Requirements: If the Scarborough Community Council wants to meet in closed session (privately), a member of the committee must make a motion to do so and give the reason why the committee has to meet privately (City of Toronto Act, 2006).
